Welcome to Helena Chocolatier. By placing an order on our website www.helenachocolatier.com, you agree to the following terms and conditions. Please read them carefully before completing your purchase.

1. ORDER ACCEPTANCE

Helena Chocolatier reserves the right to refuse or cancel any order for reasons including, but not limited to: incorrect or incomplete payment information, suspected fraud, unavailable products, or any other circumstances we deem appropriate. In case of cancellation, you will be notified by email and a corresponding refund will be processed.

2. PRICES AND TAXES

  • All prices are expressed in United States dollars (USD) and are subject to change without prior notice. Price changes only apply to future purchases and do not affect orders already placed.
  • Applicable taxes are calculated only for orders shipped to the state of Florida and are added to the total during the checkout process. The final amount, including taxes, is clearly displayed before completing your purchase.

3. PAYMENT METHODS

We accept the following forms of payment:

  • Credit and debit cards
  • PayPal
  • Money orders

Payment is authorized at the time of placing the order. However, the charge is processed when our payment gateways deposit the funds into our bank account.

4. PROCESSING AND SHIPPING

  • Processing time: All orders are processed within 24 to 48 hours after receiving payment confirmation.
  • Delivery time: Estimated shipping period is 4 to 10 business days after processing.
  • Product protection: Our chocolates are perishable products that require special care. We ship year-round using packaging with thermal protection. During summer months, we reinforce protection with refrigerant gel packs, silver thermal insulating bags, and shorter shipping periods to ensure your chocolates arrive in perfect condition.
  • Delivery responsibility: Packages do not require a signature and may be left at the provided address. The customer is responsible for providing a secure and accurate delivery address.

5. DAMAGED OR DEFECTIVE PRODUCTS

If your order arrives damaged, melted, or in unsatisfactory condition:

  • You must report it within 24 to 48 hours after receiving the package.
  • You must provide photographic evidence of the damaged product and packaging.
  • Contact our team at sales@helenachocolatier.com or (305) 970-2968.
  • Helena Chocolatier will replace the complete product or the affected portion at no additional cost to you.

6. ORDER ERRORS

If you receive an incorrect product due to an error on our part:

  • Contact our team within 24 to 48 hours.
  • We will send you a prepaid UPS return label at no cost.
  • We will resend the correct product at no additional charge.

7. CANCELLATIONS

Customers may cancel their order as long as it has not been shipped. Since we process orders within 24 to 48 hours, cancellation requests must be made within this period. To cancel, immediately contact sales@helenachocolatier.com or (305) 970-2968.

8. RETURNS AND REFUNDS

Unconsumed products:

  • We accept returns of unconsumed products within 7 days after receipt.
  • The product must be in its original packaging. One item may be opened.
  • To request a return, contact sales@helenachocolatier.com or (305) 970-2968. We will send you a prepaid UPS return label.
  • Once the return is received, you may choose between a full refund or order replacement.

Consumed products or outside the return period: We do not accept returns of consumed products or requests made after 7 days.

9. SHIPPING INSURANCE

All our shipments are insured to protect your investment during transit.

10. LIMITATION OF LIABILITY

Helena Chocolatier is not responsible for delivery delays caused by the courier service, extreme weather conditions, natural disasters, or other circumstances beyond our control. We are also not responsible for products that are damaged after delivery due to improper storage by the customer.

12. JURISDICTION AND APPLICABLE LAW

These Terms and Conditions are governed by the laws of the state of Florida, United States. Any dispute related to these terms shall be subject to the exclusive jurisdiction of the courts of the state of Florida.

13. MODIFICATIONS

Helena Chocolatier reserves the right to modify these Terms and Conditions at any time. Changes will take effect immediately after being posted on our website. It is the customer's responsibility to periodically review these terms.
